2. PURPOSE

These General Conditions explicitly regulate the terms applicable to the purchase processes conducted by users (“Customers”) of products and/or services offered by Póster Félix (“Provider”) through its website www.posterfelix.com. The provider, represented by María Carmen Bernáldez on behalf of Póster Félix, is responsible for offering these products and/or services.

These general conditions will be in force and valid for as long as they are accessible through the website. The provider reserves the right to modify these general conditions, as well as any specific conditions and any legal text displayed on the website, without prior notice. The use of the website after such modification implies acceptance of the same by the user.

The customer and all contracting processes carried out through the website are subject to the general conditions in force at the time of the corresponding contract. The temporal validity of the conditions coincides with the time they are displayed, until they are partially or fully modified. The new conditions will apply from the moment they are made available to the customer.

All purchases of products made through the website, after identification and authentication, will be considered correctly performed by the customer and will be binding.

3. PARTICIPATING ENTITIES

The electronic contracting process through the website www.posterfelix.com will be carried out between the customer and the provider. Website customers are considered to be those consumers who are natural persons over 18 years old or duly accredited legal entities that accept the applicable general and specific conditions.

4. ACCESS AND REGISTRATION ON THE WEBSITE

Access and consultation of the product and/or service catalog published on the website is free and does not require user registration. However, to purchase products and/or contract services, it is necessary to register as a user.

4.1. REQUIREMENTS TO REGISTER AS A USER You must be over eighteen years old and provide all the required data identified as mandatory in the form provided by the provider on the website.

4.2. TERMINATION AS A REGISTERED USER The legal relationship established upon registering as a customer on the website will have an indefinite duration. Both parties may unilaterally terminate or suspend this relationship. The provider reserves the right to cancel any registered user who maintains outstanding balances or unpaid amounts acquired by any means.

5. ELECTRONIC PURCHASE PROCESS OF PRODUCTS

5.1. PRODUCT INFORMATION AND AVAILABILITY

The products and/or services offered indicate the following information for each one:

  • Product name and description
  • Image(s)
  • Price

If the provider does not have stock of any of the requested products, the customer will be informed of this situation, indicating the possibility of waiting for the product to be restocked, canceling the purchase with the corresponding refund, or, where applicable, being supplied with other similar products chosen by the customer.

Some posters and original graphic works, having been printed in the past, may show signs of use. This is usually indicated in the product description. Additionally, for technical reasons, the colors of the photographs may not be identical to the original.

6. ECONOMIC CONDITIONS AND PAYMENT METHODS

6.1. ECONOMIC CONDITIONS

All products and/or services available on the website have the final price indicated. The prices shown exclusively affect the products and/or services offered through this medium and for the time they remain available on the website.

Prices are always shown in Euros and include VAT (unless otherwise indicated on the product or service), as well as any other applicable tax, and will be the current and legally applicable ones at that time. Shipping costs are additional and will be indicated before confirming the purchase.

If the provider identifies an error in the price of any product available on the website, the customer will be informed immediately. Additionally, the corresponding correction will be made on the website and in any possible communications that may have been made. The customer may reconfirm or cancel their order via email.

The provider reserves the right to modify the prices of the products and/or services available on the website at any time, without prior notice. In any case, the rates in force indicated on the website at the time of placing the order will apply, regardless of subsequent rate modifications.

6.2. PAYMENT METHODS

All payment methods provided by the provider are subject to checks and authorizations by the payment method issuing entities (card issuers and/or payment account issuers). If the entity does not authorize the payment, the order will be automatically canceled, and the purchase process of products or services intended to be acquired will not be completed.

The charge for the price of the products, shipping costs, if applicable, and applicable taxes will only be made when the order is finalized.

Users can pay quickly and securely with Stripe or PayPal, without sharing financial information with the provider. The customer will be redirected to the secure Stripe or PayPal page, where they must enter their credentials and accept the charge, or even enter their credit card details on the Stripe or PayPal platform. Once payment is confirmed, the customer will be returned to the provider’s purchase confirmation page, where they can verify the status of the completed purchase. Stripe or PayPal does not refund commissions to the seller in case of purchase cancellation, so these costs will be borne by the customer.

7. PRODUCT SHIPPING CONDITIONS

Products purchased through the provider’s website will be sent to the postal address indicated in the order form. Shipments to P.O. boxes or cash on delivery are not accepted.

Delivery to the carrier will generally be made within 5 to 15 business days from order confirmation, to the postal address included in the order data, except in cases of force majeure.

If, upon receiving the shipment, the customer observes that the package or the protective tube has suffered any damage or shows signs of impact that may affect the contents, an official claim must be made to the carrier or distributor to assume their responsibilities. If the claim is not made, it is understood that the customer agrees with the conditions in which the shipment is received. The seller’s liability for possible damages during transport is limited to the carrier’s conditions. For valuable goods, it is recommended that the customer purchase insurance.

The rates normally applied for shipping are based on the services of the national postal service, Sociedad Estatal Correos y Telégrafos, S.A., S.M.E. These rates are calculated based on the certified mail shipping of a tube that can contain up to approximately 4 reproductions and should not exceed 1000 grams in weight. Additionally, the protective tube dimensions must not exceed 80 cm in length or 10 cm in diameter.

In cases where the purchase exceeds this weight and these dimensions, or if the poster is framed and requires special packaging and protection, or if a special, urgent, or insured courier service is needed, or if the destination is outside the mentioned countries, etc., the shipping price will be determined according to each shipment’s characteristics. The customer will be informed in advance of any additional charges that may apply.

8. RIGHT OF WITHDRAWAL FROM ORDERS

Our goal is to provide our customers with the best possible service and their satisfaction. The right of withdrawal from the purchase made through our website is recognized if the customer is not satisfied. The product can be returned within a maximum of seven calendar days from receipt or withdrawal of the product. The customer must return the products subject to withdrawal without undue delay and in any case no later than seven calendar days from the date the withdrawal decision is communicated. The product(s) must be returned in perfect condition. If the return is not made in the original packaging, it will be understood that the product has suffered depreciation, which will be estimated by the provider fairly and proportionally to be deducted from the amount to be refunded. It is not possible to exchange one product for another. Custom framing or special orders on demand are excluded.

The product must be returned properly packaged and in the same condition it was delivered. Shipping costs will be borne by the customer unless justified. The purchase amount will be refunded once the merchandise is received at our facilities and verified to be in good condition. The refund amount will be calculated by deducting the outbound and return shipping costs if applicable. Stripe or PayPal commissions charged to the seller will also be deducted if the purchase was paid through this system. Stripe or PayPal policy excludes refunding their commission in case of refunds. The refund will be made using the same payment method used for the purchase, deducting the return costs, which will be borne by the customer.

The refund corresponding to the withdrawal will be made within fourteen calendar days from the date the withdrawal decision is effectively and unequivocally communicated and provided the goods or products subject to withdrawal are received in perfect condition; otherwise, the refund may be withheld until the goods are received or until the customer proves the return of the goods.

The right of withdrawal does not apply to:

  • The supply of digital content (not provided on a physical medium) when the acquisition of the services purchased (including this material) has been made. Likewise, the fact of having obtained access to any type of digital content (online through the website or offline by any other means) is excluded from the right of withdrawal. The customer expressly acknowledges that once the supply of this type of content has begun, their right of withdrawal is lost.
  • Products made according to the customer’s specifications, such as framing a poster.
  • If, upon receipt of the shipment, the customer observes that the package or protective tube has suffered damage or shows signs of impact that may affect the contents, an official claim must be made to the carrier or distributor to assume their responsibilities. If this claim is not made, it is understood that the customer agrees with the conditions in which the shipment is received. 9. GUARANTEE OF THE PRODUCTS PURCHASED

The products offered through the website are original or reproduced according to the description. The customer is fully responsible for the product’s use. No guarantee of any kind is given regarding its use or utility. The same applies to framing or the condition of vintage posters.

10. OBLIGATIONS AND RESPONSIBILITIES OF THE PARTIES

10.1. Obligations and responsibilities of the customer

The customer agrees to:

  1. Provide all the data necessary to register as a user on the website and make the purchase order for products and/or services, ensuring that the information provided is current, true, and accurate.
  2. Use the website diligently, following these general conditions and any specific conditions.
  3. Respect the purchase process, refraining from manipulating or falsifying the data entered.
  4. Respect intellectual property rights regarding the content available on the website.
  5. Be liable for all possible damages resulting from the breach of these general conditions or any other applicable regulation.

10.2. Obligations and responsibilities of the provider

The provider agrees to:

  1. Provide the customer with the necessary information and technical assistance to access the website, as well as the process for the correct use of the services and products offered.
